Guidelines for conduct of members

1.             Conduct at meetings/working groups

Agendas should be prepared for each meeting and discussion should be confined to agenda topics which must only concern the ELHUA’s overall objective of improving quality and transparency in underwriting standards and related matters.

No discussion of pricing, customers, costs, market shares or other commercially sensitive issues should occur during ELHUA meetings or before or after meetings.

Each ELHUA host member is permitted to have one or several legal and/or compliance representatives (independent third party advisers or in-house counsel) being present at the meeting(s).

Minutes should be taken of ELHUA meetings, although this may not always be appropriate for technical working group meetings.

If commercially sensitive data is to be collected and analysed, this should be done by third party advisers and presented to the ELHUA only in aggregated and anonymised format.

2.             ELHUA membership

Decisions on ELHUA membership should be made on a consistent and objective basis.

An internal record should be made of reasons for refusing an applicant membership in cases where membership is declined.

There must be no restrictions or penalties on companies or individuals which decide to leave the ELHUA.

ELHUA members should be free to join other associations or groupings of industry companies.

3.             Standard setting

Any standards being agreed by the ELHUA are subject to antitrust compliance clearance by an independent third party advisor/counsel, to be designated by the respective ELHUA host member at whose meeting such standards have been concluded.

4.             Promotion of views

 The ELHUA should ensure that in promoting its views in the public domain it does not advocate rules which appear anti-competitive or to benefit its members to the detriment of its competitors.
